• Platform: The website and related services operated by Mithqab.
• Renter: Any individual or entity that books or reserves equipment through the Platform.
• Supplier: Any individual or entity that lists equipment for rent on the Platform.
• Equipment: Heavy equipment, machinery, tools, or supplies listed by Suppliers.
• Booking / Reservation: A confirmed request made through the Platform for renting Equipment for a specific period.
• User: Any person or entity using the Platform, whether as a Renter or Supplier.

1. The Platform acts solely as a technology intermediary that enables communication, listing, booking, and scheduling between Renters and Suppliers.
2. No online payments are currently processed through the Platform. All payments, fees, deposits, or financial arrangements are handled offline and directly between Renters and Suppliers.
3. The Platform is not a party to any rental agreement formed between a Renter and a Supplier and does not assume responsibility for the performance of either party.

1. Users must be legally capable of entering into binding contracts under the laws of the Kingdom of Saudi Arabia.
2. Businesses must be duly licensed and authorized to operate in Saudi Arabia.
3. Users agree to provide accurate, complete, and up-to-date information during registration.
4. Each User is responsible for maintaining the confidentiality of their account credentials.

Suppliers agree that:

1. All listed Equipment is owned, leased, or legally authorized to be rented by the Supplier.
2. Equipment descriptions, specifications, availability, pricing, and images are accurate and not misleading.
3. Equipment is maintained in safe, operable, and compliant condition, in accordance with Saudi safety regulations and industry standards.
4. All required permits, licenses, inspections, and insurance related to the Equipment are valid and up to date.
5. Delivery, pickup, operator provision (if any), and insurance terms are clearly communicated to the Renter.

Renters agree that:

1. Equipment will be used only for lawful purposes and in compliance with Saudi laws, regulations, and safety standards.
2. Equipment will be operated by qualified and authorized personnel.
3. Equipment will not be sub-rented, modified, or misused without Supplier consent.
4. Equipment will be returned on time and in the same condition, subject to normal wear and tear.
5. The Renter bears responsibility for damages, loss, fines, or penalties arising during the rental period, unless otherwise agreed with the Supplier.

1. Bookings and rental periods are managed exclusively through the Platform.
2. A booking is considered confirmed once accepted by the Supplier.
3. Any changes, extensions, or cancellations must be coordinated through the Platform and confirmed by both parties.
4. The Platform is not responsible for availability conflicts, delays, or disputes arising from bookings.

1. The Platform does not process or collect payments at this time.
2. All rental fees, deposits, penalties, and taxes are agreed upon directly between the Renter and Supplier.
3. The Platform is not responsible for payment disputes, late payments, or non-payment.
4. Users are responsible for complying with Zakat, Tax, and Customs Authority (ZATCA) regulations, including VAT where applicable.

1. Cancellation terms are determined by the Supplier and must be clearly stated in the listing or agreed upon with the Renter.
2. Failure to honor a confirmed booking may result in account suspension or other actions deemed appropriate by the Platform.

1. Renters and Suppliers are solely responsible for obtaining appropriate insurance coverage, including third-party liability and equipment damage insurance.
2. The Platform is not liable for:
   • Accidents, injuries, or death
   • Equipment malfunction or defects
   • Property damage or project delays
3. Use of the Platform and Equipment is at the User's own risk, to the maximum extent permitted under Saudi law.

Users must not:

• Provide false or misleading information
• Use the Platform for illegal or unethical activities
• Violate Saudi laws, Islamic values, or public order
• Upload harmful, offensive, or inappropriate content
• Interfere with Platform security or operations

The Platform reserves the right to:

1. Suspend or terminate accounts that violate these Terms.
2. Remove listings or bookings that are inaccurate, unlawful, or harmful.
3. Take necessary action to protect the Platform, its Users, and the public.

1. All Platform content, trademarks, logos, and software are owned by or licensed to Mithqab.
2. Users may not copy, modify, distribute, or exploit Platform content without written permission.

1. User data is handled in accordance with the Saudi Personal Data Protection Law (PDPL).
2. By using the Platform, Users consent to the collection and processing of personal data for operational purposes.

1. These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.
2. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia, unless amicably resolved otherwise.

The Platform may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
